Underground Storage Tanks Program

Due to the overwhelming public interest in the department’s efforts to regulate the Red Hill Bulk Fuel Storage Facility (aka, the “Red Hill Facility”), this site will host documents related to those efforts and provide a platform for any member of the public to review and download them.  The department intends to continue to make available, and to update as necessary, all records and external communication exchanged between the department and the Navy regarding the operation and maintenance of, and any release responses related to, the Red Hill Facility.

Please note that the Navy has redacted material from these documents to protect critical infrastructure in the interest of national security pursuant to its authority to do so in 10 United Statutes Code (U.S.C.) 130e and to protect personal privacy.  If you have any questions or concerns about the redactions, please contact the Navy.  The refence to “(b)(3)” where the redactions occur is to 5 U.S.C. 552(b)(3) which is the exemption to the general rule of disclosure in the Federal Of Information Act (“FOIA”) that prohibits disclosure of information otherwise protected by statute.  Pursuant to 92F-13(4), Hawaii Revised Statutes, the department is obligated by law not to disclose the redacted material.
