DOH ISSUES ENFORCEMENT ACTION TO ABC TOWING & PARTS, LLC AND JH HAWAII PROPERTY, LLC ON OʻAHU
Posted on Mar 11, 2025 in NewsroomHONOLULU — The Hawaiʻi Department of Health (DOH) has issued a Notice of Violation and Order (NOVO) to both ABC Towing & Parts, LLC and JH Hawaii Property, LLC for polluted discharge to Waiawa Stream, and for operating without a required National Pollutant Discharge Elimination System (NPDES) permit at the ABC Towing & Parts facility located in Pearl City, O‘ahu.
The citation orders a monetary penalty of $55,000 and corrective actions to be taken, including applying for permit coverage for the discharge of stormwater associated with industrial activities.
Industrial facilities subject to regulation under the NPDES program are required to have permit coverage prior to initiating discharges. Failure to do so, creates an unfair advantage over other industrial facilities that dedicate resources toward environmental protection. Property owners that allow facilities to operate on their properties are liable for their tenants and therefore must ensure appropriate permits are obtained.
Property owners and industrial facilities must comply with laws designed to protect Hawaiʻi’s environment. Failure to comply with water pollution laws may subject violators to monetary penalties of up to $60,000 per day, per violation.
Hawaiʻi’s water pollution control laws protect public health and the environment by prohibiting discharges that harm water quality. The DOH Clean Water Branch (CWB) enforces these laws, and violations may lead to further legal action from the state, federal agencies, or private citizens.
